1. Definitions
“Starbright Cinema” refers to the service provider supplying outdoor and indoor cinema hire services.
“Client” refers to the individual, organisation, or entity booking the services.
“Services” refers to the hire of cinema equipment, technical setup, operation, and related support services.
“Event” refers to the date, time, and location for which the services are booked.
2. Application of Terms
These Terms and Conditions apply to all quotations, bookings, agreements, and services provided by Starbright Cinema and must be read together with the Refund and Cancellation Policy.
By accepting a quotation, making payment, or allowing services to commence, the Client agrees to be bound by these Terms and Conditions.
3. Quotations and Pricing
All quotations are valid for 7 days unless otherwise stated.
Prices are based on the information provided by the Client at the time of quotation.
Any changes to event details (venue, duration, setup requirements, audience size, or equipment) may result in a revised quotation.
4. Booking Confirmation and Payment
A booking is confirmed only once written acceptance and the required deposit have been received.
The balance of payment must be settled prior to or on the event date, unless otherwise agreed in writing.
Starbright Cinema reserves the right to withhold services if payment terms are not met.
5. Client Responsibilities
The Client is responsible for:
Providing accurate event details and access to the venue.
Ensuring a safe, level, and suitable setup area.
Supplying a reliable power source, unless otherwise agreed.
Obtaining all necessary permissions, licences, and approvals (including film screening rights, venue permissions, and municipal approvals where required).
Ensuring reasonable crowd control and security during the event.
6. Film Licensing and Content
Starbright Cinema does not provide public performance or screening licences unless explicitly stated in writing.
The Client bears sole responsibility for ensuring compliance with copyright and licensing requirements.
Starbright Cinema shall not be held liable for any claims arising from unauthorised screenings.
7. Event Timing and Access
Setup and breakdown times will be agreed in advance.
Delays caused by the Client, venue, or third parties may reduce screening time.
Extensions beyond the agreed event time may incur additional charges.
8. Outdoor Events and Weather
Outdoor events are subject to weather conditions.
Starbright Cinema reserves the right to delay, suspend, or terminate services if conditions are deemed unsafe.
Weather-related matters are governed by the Refund and Cancellation Policy.
9. Equipment Use and Care
All equipment remains the property of Starbright Cinema.
The Client is responsible for ensuring equipment is protected from damage, theft, vandalism, liquids, and misuse during the event.
Any loss or damage caused by the Client, guests, or third parties may be charged to the Client.
10. Liability and Indemnity
Starbright Cinema will take reasonable care in providing its services.
To the extent permitted by the Consumer Protection Act, Starbright Cinema shall not be liable for indirect, consequential, or economic losses.
The Client indemnifies Starbright Cinema against claims, damages, or losses arising from:
Unsafe venues or conditions;
Audience behaviour;
Unlicensed content;
Client or third-party negligence.
11. Limitation of Liability (CPA Compliance)
Nothing in these Terms limits any rights the Client may have under the Consumer Protection Act.
Where permitted by law, Starbright Cinema’s total liability shall be limited to the total amount paid by the Client for the specific event.
12. Force Majeure
Starbright Cinema shall not be liable for failure or delay in performance due to events beyond reasonable control, including acts of God, extreme weather, power outages, government restrictions, or public safety concerns.
13. Right of Refusal
Starbright Cinema reserves the right to refuse or discontinue services where:
Conditions are unsafe;
Payment obligations are not met;
The Client breaches these Terms;
Conduct is abusive, unlawful, or places equipment or staff at risk.
14. Privacy and Personal Information
Personal information collected will be handled in accordance with the Protection of Personal Information Act (POPIA) and used solely for business and contractual purposes.
15. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
16. Entire Agreement
These Terms and Conditions, together with the Refund and Cancellation Policy and accepted quotation, constitute the entire agreement between the parties.
